Toddler Town: Pop-Up Role Play ("we", "us", "our") provides pop-up imaginative role play experiences for toddlers and young children across Devon and Somerset. These terms and conditions govern the provision of our services. By booking or attending any of our sessions or events, you ("you", "your") agree to be bound by these terms. Please read them carefully before making a booking.

Part A — General Terms (All Services)

1. Definitions

  1. "Services" means the children's pop-up role play sessions and/or party hire services provided by us.
  2. "Equipment" means all role play rooms, props, materials, toys, furniture, costumes and other property owned by us and used in the provision of the Services.
  3. "Premises" means the venue or location at which the Services are provided.
  4. "Session" means a designated Stay & Play session as described in Part B.
  5. "Party" means a private party hire booking as described in Part C.
  6. "Booking" means a confirmed reservation for a Session or Party.
  7. "Price" means the total cost for the Services as confirmed at the time of booking.
  8. "Deposit" means a non-refundable sum equal to 25% of the Price, payable to secure a Party booking.

2. Entering into a Contract

  1. A legally binding contract between you and us comes into being when:
    1. for Sessions: you complete a booking and make payment in full; or
    2. for Parties: you complete the booking process and pay the Deposit.
  2. We recommend that you read these terms carefully before booking. If you have any questions, please contact us before confirming.
  3. You should keep a copy of these terms for your records.

3. Providing the Services

  1. We will provide the Services using reasonable care and skill, in compliance with commonly accepted practices and standards in our industry, and in compliance with all applicable laws and regulations.
  2. We will ensure that one of our representatives is present at all times during the provision of the Services to provide information and answer questions.

4. Supervision and Parental Responsibility

  1. All children must be accompanied and supervised by a responsible parent, carer or guardian (aged 16 or over) at all times during the Services. We do not provide childcare or supervision of children.
  2. You are solely responsible for the safety, behaviour and wellbeing of all children in your care throughout the Services, including during set-up and pack-down where applicable.
  3. You must ensure children use all Equipment safely and appropriately and in accordance with any instructions given by us.
  4. You must ensure children are safely away from Equipment during set-up and pack-down.
  5. Children who are not yet walking independently must be closely supervised at all times, particularly around Equipment designed for older toddlers.

5. Health, Illness and Hygiene

  1. You must not attend any Session or Party if you or any child in your care is unwell or showing signs of illness, including but not limited to: fever or raised temperature, vomiting, diarrhoea, unexplained rash, or symptoms of a contagious illness.
  2. If you or a child in your care has experienced vomiting or diarrhoea, you must not attend until at least 48 hours have passed since the last episode.
  3. In the case of contagious conditions such as chickenpox, hand foot and mouth disease, impetigo, conjunctivitis or similar, you must not attend until the child is no longer contagious in accordance with NHS guidance.
  4. If a child becomes unwell during a Session or Party, we reserve the right to ask the parent or carer to leave immediately with the unwell child for the safety of other attendees. No refund will be given in these circumstances.
  5. We clean and sanitise all Equipment after every use. We ask that you ensure children have clean hands before using the Equipment.
  6. Nappies must be changed in designated areas or toilet/changing facilities at the Premises only, not in or near the play areas.

6. Food, Drink and Allergies

  1. Children must not consume food or drinks near or whilst using the Equipment, unless we have designated a specific area for this purpose.
  2. If your child has any allergies (food or otherwise), medical conditions or additional needs, you must inform us prior to attending or at the time of booking.
  3. We are not responsible for managing or monitoring children's allergies. This remains the responsibility of the supervising parent or carer at all times.

7. Behaviour

  1. We expect all attendees to behave respectfully and considerately towards other families, our staff and the Equipment.
  2. Aggressive, abusive, threatening or antisocial behaviour will not be tolerated. We reserve the right to ask any person to leave immediately without refund if their behaviour poses a risk to the safety, comfort or enjoyment of others.
  3. Bullying of any kind will not be tolerated.
  4. Pets and animals are not permitted (except registered assistance dogs).
  5. Smoking and vaping are not permitted at or near the play areas.
  6. You must not attend whilst under the influence of alcohol or drugs.

8. Footwear and Clothing

  1. For safety and hygiene, we may require shoes to be removed before entering play areas. Socks should be worn by both adults and children.
  2. We recommend comfortable clothing suitable for active play. We are not responsible for damage to clothing during the Services.
  3. Dangling jewellery, scarves and loose accessories that could become caught in Equipment should be removed or secured.

9. Photography and Video

  1. If you wish to take photographs or videos during the Services, you must:
    1. obtain the consent of all persons who may feature (or, for children, their parent/carer/guardian) before doing so; and
    2. retain any photographs or videos for personal use only. You must not publish images featuring other people's children on social media or any public platform without their express consent.
  2. We may occasionally take photographs or videos for marketing purposes. We will always seek your consent before including you or your child.

10. Personal Belongings

  1. You are responsible for your personal belongings at all times. We accept no liability for any loss, theft or damage to personal property brought to the Premises.
  2. Please use designated pram/buggy parking areas where provided.
  3. All property belonging to Toddler Town must remain at the Premises when you leave.

11. Equipment and Damage

  1. All Equipment is purchased from reputable providers, conforms to applicable safety standards, and is regularly inspected, maintained and cleaned.
  2. You must not tamper with, modify or misuse any Equipment.
  3. You will be responsible for the cost of repairing or replacing any Equipment damaged (deliberately or through negligence) by you or any children in your care.
  4. You agree to indemnify us against any claim from the owner or operator of the Premises for damage caused by you or any attendees, including damage or staining to walls, floors, furniture or fittings.

12. Our Right to Refuse or Terminate Service

  1. We reserve the right to refuse entry to, or require any person to leave, a Session or Party if:
    1. any person (including a child) is showing signs of illness;
    2. any person is under the influence of alcohol or drugs;
    3. behaviour is aggressive, threatening, abusive or poses a risk to others;
    4. the maximum number of attendees has been exceeded;
    5. payment has not been made in accordance with these terms; or
    6. any person fails to comply with these terms or reasonable instructions from our staff.
  2. In such circumstances, no refund will be given.

13. Limitation of Liability

  1. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.
  2. Subject to clause 13.1, we shall only be liable for loss or damage that is a reasonably foreseeable consequence of a breach by us of these terms. Our liability shall not extend to any loss of profit, loss of enjoyment or amenity, or any special, indirect or consequential loss.
  3. We hold public liability insurance. Our total liability in respect of all claims arising under these terms shall not exceed the limits of our insurance cover. Details are available on request.
  4. We are not responsible for any injury, loss or damage arising from a child's use of Equipment where the supervising adult has failed to adequately supervise in accordance with these terms.

14. Force Majeure

  1. We shall not be liable for any failure or delay in providing the Services caused by circumstances beyond our reasonable control, including but not limited to: severe weather, flood, fire, epidemic or pandemic, government restrictions, venue closure, vehicle breakdown, illness of key staff, or any other force majeure event.
  2. In such circumstances, we will provide as much notice as reasonably possible and offer either an alternative date or a full refund at your choice.

15. Data Protection and Privacy

  1. We are committed to protecting your personal information. Personal data you provide will be held and processed in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
  2. We will use your data only for managing bookings, providing the Services, communicating with you, and meeting legal obligations.
  3. We will not share your personal information with third parties for marketing purposes without your express consent.
  4. You have the right to request access to, correction of, or deletion of your personal data at any time by emailing info@popup-toddlertown.co.uk.

16. Communication

  1. You can contact us by email at info@popup-toddlertown.co.uk or via our Facebook and Instagram pages. For important matters (including cancellations and complaints), please contact us in writing by email.
  2. If we need to contact you, we will use the details provided at booking.

17. Complaints

  1. If you are dissatisfied with any aspect of our Services, please contact us as soon as possible by email at info@popup-toddlertown.co.uk.
  2. We will acknowledge your complaint promptly and endeavour to resolve it fairly and within a reasonable timeframe.

18. Amendments

  1. We reserve the right to amend these terms at any time. Changes will be posted on our website and take effect from the date of publication.
  2. The terms in effect at the time of your booking will apply to that booking.

19. Third Party Rights

  1. For the purposes of the Contracts (Rights of Third Parties) Act 1999, these terms do not give any person who is not a party to them any right to enforce any of their provisions.

20. Governing Law

  1. These terms shall be governed by the law of England and Wales. You and we submit to the exclusive jurisdiction of the courts of England and Wales.
Part B — Stay & Play Sessions

The following terms apply specifically to our Stay & Play sessions, in addition to the General Terms in Part A.

21. Booking and Entry

  1. All Sessions must be booked and paid for in advance. Walk-ins may be accommodated subject to availability, but entry without a prior booking cannot be guaranteed.
  2. Each booking admits one child and one accompanying adult (aged 16+). Additional children or adults may be subject to an additional charge as specified at the time of booking.
  3. Babies under 12 months or those who are not yet mobile may attend free of charge with a paying sibling, at our discretion.
  4. Where sibling discount is applied, all attendees must live at the same address.
  5. Sessions are intended for toddlers and young children. We may specify age guidance for individual sessions — please check at the time of booking.
  6. Adults attending without a child will not be admitted.

22. Session Duration and Timing

  1. Each Session is for a designated time period as specified at the time of booking.
  2. You must not enter the play area until invited to do so by our staff, so as not to disrupt any prior session or set-up.
  3. You must be ready to leave the play area promptly at the end of the Session to allow us to clean, reset and prepare for the next session.
  4. If you arrive late, the Session will still finish at the scheduled end time. We are unable to extend the Session or offer a partial refund for late arrivals.

23. Session Capacity

  1. For the safety and enjoyment of all attendees, each Session is limited to a maximum number of children as determined by us. This limit will be enforced at all times.
  2. We reserve the right to limit the number of bookings available for each Session.

24. Payment for Sessions

  1. The Price for each Session is as stated on our booking system or as communicated at the time of booking.
  2. Payment is required in full at the time of booking. You will not be permitted to attend if payment has not been made.
  3. Session prices are subject to change. The price in effect at the time of your booking will apply.

25. Cancellation and Refunds (Sessions)

  1. All Session bookings are non-refundable.
  2. If you are unable to attend a booked Session, you may transfer your booking to an alternative Session as a one time option, provided that:
    1. you notify us at least 24 hours before the start of your booked Session;
    2. the alternative Session has availability; and
    3. the transfer is to a Session within 90 days of the original booking date.
  3. Transfer requests made less than 24 hours before the Session start time will not be accommodated and no refund will be given, except where the reason is a contagious illness (in which case we will endeavour to offer an alternative date).
  4. If we are unable to provide the Session for any reason (including venue issues, staff illness or circumstances beyond our control), we will offer you either an alternative Session or a full refund at your choice.
  5. The provisions of Part 3 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 do not apply to Session bookings, as the contract falls within the exemption in Regulation 28(1)(h) (services related to leisure activities where the contract provides for a specific date of performance).
Part C — Toddler Town Parties

The following terms apply specifically to our Toddler Town Party hire service, in addition to the General Terms in Part A.

26. The Premises (Party Hire)

  1. Toddler Town Parties are a mobile service — we travel to a venue of your choice within our coverage area (Devon and Somerset). Unless otherwise agreed in writing, you are responsible for:
    1. hiring and meeting all costs associated with the Premises;
    2. ensuring the Premises are suitable for the Services, including sufficient space for our 8 role play rooms and the agreed number of children;
    3. ensuring the Premises are booked for the agreed date and time, including adequate time for our set-up and pack-down (we will advise you of the time required);
    4. ensuring adequate access for loading in Equipment (parking, doorway widths, stairs/lifts etc.);
    5. notifying us within 7 days of the booking of any rules, restrictions, access issues or other relevant information about the Premises; and
    6. ensuring adequate toilet and nappy-changing facilities for the expected number of attendees.
  2. If the Premises are unsuitable for the safe provision of the Services (for example, insufficient space, hazards or access issues not previously disclosed), we reserve the right to decline to provide the Services. In such circumstances, the Deposit will not be refunded.

27. Party Duration and Timing

  1. Party hire is for a minimum of 2 hours of play time, or as otherwise agreed at the time of booking and must include any other party elements inclusive of time for refreshments.
  2. Set-up and pack-down time is in addition to the play time. You must ensure the Premises are available for the full duration including set-up and pack-down. The additional time required for this will be confirmed at the time of booking.
  3. You and your guests must not access the play area until invited to do so by our staff.
  4. You and your guests must vacate the play area at the end of the allocated play time to allow us to pack down.
  5. If you arrive late, the Party will still finish at the scheduled end time. We are unable to extend the party time.
  6. Additional time beyond the agreed hire period may be available at our discretion and will be subject to an additional charge agreed in advance.

28. Maximum Number of Children (Parties)

  1. The maximum number of children permitted will be agreed at the time of booking.
  2. If the number of children exceeds the agreed maximum, we reserve the right to refuse entry to additional children or to cease providing the Services. No refund will be given.
  3. It is your responsibility to manage guest numbers and RSVPs.

29. Deposit and Payment (Parties)

  1. A non-refundable Deposit of 25% of the Price is required to secure your Party booking. Your booking is not confirmed until the Deposit has been received.
  2. The remaining balance must be paid no later than 1 month before the date of the Party, unless otherwise agreed in writing.
  3. If the remaining balance is not paid by the due date, we reserve the right to cancel the booking. The Deposit will not be refunded.
  4. Where additional charges become payable (for example, additional hire time or damage to Equipment), these must be paid promptly on request.

30. Cancellation by You (Parties)

  1. If you wish to cancel your Party booking, you must notify us in writing by email to info@popup-toddlertown.co.uk.
  2. Cancellation more than 1 month before the Party date: You will forfeit the Deposit (25% of the Price). Any other payments will be refunded in full.
  3. Cancellation between 14 days and 1 month before the Party date: You will forfeit 50% of the total Price. Any balance will be refunded.
  4. Cancellation less than 14 days before the Party date: No refund will be given, as we will have committed staff and resources to your event and may be unable to rebook the date.
  5. We may, at our sole discretion, offer to reschedule your Party to an alternative date instead of cancellation. An administration fee may apply.
  6. The provisions of Part 3 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 do not apply to Party bookings, as the contract falls within the exemption in Regulation 28(1)(h) (services related to leisure activities where the contract provides for a specific date of performance).

31. Cancellation by Us (Parties)

  1. If we are unable to provide the Services on the agreed date for any reason, we will notify you as soon as reasonably possible.
  2. In such circumstances, we will offer you either an alternative date or a full refund of all monies paid (including the Deposit), at your choice.

32. Your Obligations (Parties)

  1. In addition to the obligations in Part A, when hosting a Toddler Town Party you must:
    1. be present (or ensure a responsible adult nominated by you is present) at the Premises for the entire duration, including set-up and pack-down;
    2. provide any information we reasonably require to supply the Services safely, including details of allergies, additional needs or relevant information relating to attending children;
    3. inform us at least 7 days in advance of any other entertainment being provided at the same event (such as bouncy castles, additional soft play, entertainers or similar). It is your responsibility to ensure sufficient space for our Services alongside any other entertainment;
    4. ensure all children are supervised by their own parent, carer or guardian at all times;
    5. not bring in additional decorations (such as balloons, banners or confetti) into or near the play areas without our prior consent;
    6. ensure that all attendees vacate the play area promptly at the end of the allocated time.

33. Other Party Arrangements

  1. Our Services are limited to the provision, set-up and pack-down of the Toddler Town role play rooms and Equipment. All other aspects of the party or event are your sole responsibility.
  2. This includes, but is not limited to: food, drinks, refreshments, party bags, decorations (outside the play area), additional entertainment, cake, and any other activities or services you choose to provide.
  3. We accept no liability for any loss, injury or damage arising from refreshments, entertainment or any other element of the party or event that is not directly provided by us.

34. Free Stay & Play Token (Birthday Child)

  1. Where a Party booking includes a complimentary Stay & Play token for the birthday child, this token:
    1. is valid for one child only (the birthday child);
    2. is valid for 12 months from the date of the Party;
    3. is subject to availability and must be booked in advance;
    4. has no cash value and cannot be exchanged for a refund; and
    5. is non-transferable.

35. Travel and Coverage Area

  1. We currently cover locations across Devon and Somerset. Travel to your chosen venue is included in the Price unless the venue falls outside our standard coverage area.
  2. For venues outside our standard coverage area, an additional travel surcharge may apply. This will be confirmed at the time of booking.
  3. We reserve the right to decline bookings for locations that are, in our reasonable opinion, too far from our base or not safely accessible.

36. Promotional Offers (Parties)

  1. Any promotional offers or discounts (including introductory offers) are subject to availability and may be withdrawn at any time without notice.
  2. Promotional offers cannot be combined with other discounts or offers unless expressly stated.
  3. Promotional pricing applies at the time of booking only and cannot be applied retrospectively.
